dangerous condition of public road - no median barrier on freeway
This case involved a tragic incident wherein the majority of the family members lost
their lives as a result of a head on collision due to lack of a median barrier on the highway
in question.
At the time of the accident, decedent child 11 years of age, and her sister, then 6
years of age as well as their mother and father, were on their way to Mexicali, to celebrate
a birthday party. Traveling behind them were their good friends, along with their son. They
were traveling eastbound on the 60 Freeway in the number 1 lane at approximately speed
of 65 mph. Another driver traveling westbound on the 60 Freeway in the number 1 lane,
lost control of her vehicle and for unknown reasons traveled across the dirt median
between the east and westbound lanes of the 60 Freeway and hit the decedents vehicle
head on. The impact caused fatal injuries. The decedents son was at the scene of the
accident on the side of the freeway and watched his family die.
This case was against the State of California for not installing a median barrier at
the accident location despite an extensive history of cross median accidents.
