This action involved a trip and fall incident wherein Plaintiff was visiting her friend who resided in a house owned by Defendants. Upon leaving Defendant’s premises, Plaintiff walked down 3 stairs and as she stepped off the bottom stair Plaintiff stepped on a garden hose and fell.

Plaintiff contended that the garden hose was left in an unsafe place at the bottom of Defendant’s stairs and that the Plaintiff was not able to see it due to it’s color and close proximity to the bottom of the stair. Plaintiff argued that the stairs should have had a handrail and that the handrail would have prevented the Plaintiff from falling.

Defendants disputed that a handrail was required and disputed that there was a hose at the location where the Plaintiff fell. The Defendants contended that the Plaintiff fell due to her own inattention and that if there was a hose it was in an open and obvious condition.

As a result of the accident, the Plaintiff suffered fracture of the tibia and fibula requiring an open reduction internal fixation. The Plaintiff had continuing pain in her ankle of a chronic nature and argued to the jury that she will have pain in her ankle for the rest of her life. Specials in evidence were $32,000 for past medical expenses and $5,000 for future hardware removal.
