auto accident causing permanent injuries
This action involved a car vs truck accident wherein Plaintiff was eastbound on
Eighth Street, in the City of Los Angeles when Defendant a delivery driver within the course
and scope of his employment, negotiated a left turn mid block in front of Plaintiff’s
automobile. The accident required Plaintiff to wear a leg length cast. While wearing the
cast Plaintiff slipped and fell and re-injured her leg. On the first day of trial Defendants
admitted fault for the collision, but disputed the nature, extent and severity of Plaintiff’s
injuries and damages and disputed causation for the injuries caused as a result of the fall.
Plaintiff contended that she had a permanent impaired ability to walk as a result of
the accident. Plaintiff believed she would not be able work full time due to the pain and her
ability to work was limited to 4 hours per day.
Defendant’s Contended that Plaintiff suffered a broken leg with good results after
surgery. She had little residuals and could work full time since she performed office work.
Plaintiff did not need any future medical care.
Plaintiff, however, proved that despite Defendant’s contention, Plaintiff suffered a
fractured tibia and fibula in the left leg and soft tissue low back pain. The tibia fracture
required a metal plates to stabilize. After Plaintiff’s subsequent slip and fall the fracture
had to be reset and another steel plate surgically inserted. Plaintiff had residual constant
pain in the left leg causing Plaintiff to alter her gait so she cannot put all of her weight on
her left leg.
